Referral and Affiliates - Terms & Conditions
Hersh Referral Program provides individuals who are interested in referring their family and friends (“referees”) the opportunity to refer eligible individuals to join the Hersh community as new customers (“Referees”). These Program Rules below apply to Affiliates, referees and Referees, so please read carefully to understand your respective rights and obligations.
Hersh users and referees will be able to email the information in order to receive the referral reward off their first order. Once the deposit has been paid and redeemed, the referrer will receive a referral reward applied to there Hersh account and email of this will be sent
referees and Referees will receive one reward for each successful referral/new account activation.
The referee's objective is to promote Hersh's products and services to others through your personal email lists, websites, or social media pages, in exchange for offers for discounts on Hersh's products and services.
You may also receive, at Hersh’s discretion, additional offers for discounts on Hersh products and services.
You must be an active Hersh customer to earn rewards for your referrals.
You need to sign up for the Referral Program by submitting your email address (this will also be your user ID), your name, your phone number, and accepting the Terms & Conditions of the program.
You cannot refer yourself. Please note when you join the loyal scheme you will restart at stage one of the scheme, Referral booking isn't included as your first booking
You cannot exceed £5000 in rewards per calendar year. This is subject to be reviewed
You cannot promote your code through paid online ads, such as Google Search Ads or Bing Search Ads.
You cannot sell or resell Hersh’s products or services.
Each referral discountwill be applied to your account within 4 weeks after your referee places his/her first order.
Please allow up to 4 weeks after each successful referral for the service discountto be applied.
If further action is required for reward issuance, you must successfully complete the additional action within 30 days from the initial notification of request for further action to earn the reward, otherwise the member will forfeit the pending reward.

To be eligible to participate in the Referral Program as an referee, you must (a) be a legal resident of the United Kingdom; (b) be at least 18 years old; (c) have an active Hersh account in good standing; and (d) be a resident in a market that Hersh currently serves. If you violate the Referral Program Rules or any applicable Terms of Service, Hersh may, in its sole discretion, suspend or terminate your ability to participate in the Referral Program under any or all of your accounts.
As an referee, you agree that you are an independent contractor and not an employee, agent, partner or franchisee of, or joint venturer with, Hersh. You cannot act on behalf of, represent or execute contracts on behalf of Hersh. You also do not have any authority to incur any debt, obligation or liability on behalf of Hersh.
You may refer eligible individuals to become new customers on the Hersh. This must be done via email. In order to be eligible for a Referral Reward (defined below) for a new customer, the person must (i) have never previously created a Hersh account; (ii) be at least 18 years old, (iii) be a resident in a market that Hersh currently serves, and (iv) satisfy the applicable Reward Criteria, as discussed below. If these conditions are met, the person shall be considered your “Referred Customer.”
You must disclose to all Referees that you are receiving compensation for any referrals that you make, which may include cash, discounts, Hersh products and series, promotional items, or other items of value.
New customers you refer may receive Hersh's discount upon creating their new Hersh account. Referral discount is only valid for use on the Hersh Platform and is not transferable or redeemable for cash. Referral discount may contain certain restrictions such as expiration dates or geographical use limitations which will be communicated to the new customer. In order to satisfy the Referral Criteria, the referred customer must make their first Hersh purchase before the Referral discount expires, but in no event later than thirty (30) days from the creation of their Hersh account. All terms and conditions for the distribution and use of Referral discountare determined by Hersh in its sole discretion.
The maximum amount of Referral Rewards that Hersh will pay for Referred customers is £250. You may not create multiple Hersh accounts to circumvent the Referral Reward maximum, and Hersh may withhold or deny any amounts above the maximum Referral Reward. Hersh reserves the right to change this maximum amount, and it is your responsibility to review the Referral Program Rules for the current maximum limits.
Only one person can earn a Referral Reward for a single Referred customer. In the event that multiple persons claim discount for a particular referral, Hersh has full discretion to determine which person earned such referral according to Hersh’s systems.
Hersh reserves the right to withhold or deduct Referral Rewards or Referral discountobtained through the Referral Program in the event that Hersh determines or believes that the receipt of the Referral Reward or Referral discount was in error, fraudulent, illegal, or in violation of these Referral Program Rules or any other applicable agreement between you and Hersh.
In connection with your participation in the Referral Program, you expressly agree to the restrictions listed below. When distributing, promoting or communicating your Referral Code(s) you agree that:
No Spamming. You agree that you will not “spam” anyone with invitations to join the Hersh community, and that you at all times will remain compliant with applicable laws, including, but not limited to, those laws concerning the use of e-mail and text messages to advertise or promote a business and the use of endorsements and testimonials in advertising. The following specific activities are prohibited:
Mass emailing, texting or messaging people you do not personally know;
Use of automated systems or bots through any channel to distribute, post or respond to your Referral Code;
Use of scripts, programed or automatic dialers to send invites or to communicate Referral Codes;
Posting Referral Codes on event or venue pages without express permission from the owner; and
Posting referral codes on websites or social media pages that are not owned or maintained by you.
No Misrepresentations. You agree that you will not attempt to mislead anyone in connection with the Referral Program, either by affirmative representation, implication, or omission. In particular, you agree that you will not:
Impersonate any person or entity;
Create fake accounts, blogs, webpages, profiles, websites, links or messages;
Misrepresent your relationship with Hersh or any other third party (Don’t create content or communications that could have the effect of leading a consumer to believe that it is an official communication from Hersh); or
Suggest that an affiliation or partnership exists with a third party where none exists. Don’t make misrepresentations with respect to the characteristics or qualification requirements for any referral rewards. You acknowledge that Hersh may change the characteristics or qualification requirements for referral rewards in its discretion, and therefore you shall not represent any fixed characteristics (e.g., amount of Hersh credit, expiration date).
Prohibited Content. You agree that you will not use the Hersh brand in connection with:
Disparaging or defamatory content concerning Hersh or third parties;
Content which promotes racism, bigotry, hatred, discrimination or physical harm of any kind against any group or individual;
Offensive, abusive, intimidating or harassing content;
Content that is sexually explicit, obscene and/or contains nudity;
Any political and/or religious statement;
Content containing images or reference to drugs, alcohol, tobacco, vaping, e-cigarettes, weapons or firearms; or
Content that violates someone else’s privacy.
Other Restrictions. You also agree that you will not:
Specify the monetary amount of the referral code unless authorized by Hersh in writing;
Create websites, domains, URLs, social media handles or email addresses containing the word “Hersh;”
Reproduce or use Hersh’s name, logo, trademarks or other intellectual property without the prior written approval of Hersh;
Use the names or marks of Hersh competitors;
Use images of celebrities or other public or private figures without their written consent;
Use someone else’s brand name or intellectual property without their written consent (for example, referencing “Superbowl” or “Coachella” would be prohibited);
Engage in phishing or attempting to obtain financial or other personal information;
Solicit passwords or personally identifiable information;
Sell your Referral Code. You agree that you will only distribute your Hersh Code free of charge and exclusively for promotional purposes. You may not sell, trade, or barter your Hersh Code under any circumstances. You may not pay or provide anything of value to an invited user beyond any referral discountor collateral supplied by Hersh;
Violate or infringe the rights of a third party - You will not create any Hersh Code that infringes on the intellectual property rights of any third party;
Advertise -- You agree that you will not pay to advertise your Hersh Code or the Referral Program, including via Google, Facebook, Twitter, Bing and Craigslist;
Create printed materials other than those authorized by Hersh (including but not limited to: VistaPrint);
Post printed materials on public or private property without the express written consent;
Engage in fraudulent activity -- You agree that you and your referrals will not defraud or abuse (or attempt to defraud or abuse) Hersh, the terms of the Hersh Referral Program, or any invited users; or
Act as a brand ambassador or referee, or otherwise promote, any product or service that competes with Hersh.
Minimum order value may be required for both referee and Referee.
Only one referral discountcan be used per order for both the referee and the Referee.
If you violate any of these restrictions Hersh may, in its discretion, remove your eligibility to participate in the Referral Program, and/or deny you any Referral Rewards earned in violation or suspected violation of these restrictions.
Other Terms
The following terms shall also apply to your participation in the Referral Program.
Customers cannot earn Referral Rewards for referring themselves.
In exchange for allowing you to promote your Hersh Code online (subject to the restrictions above), you agree to include a link on any such promotion page back to Hersh’s promotion page (or such other page as Hersh designates).
All Hersh promotions run for a limited time only and are subject to change at Hersh’s discretion.
Information and materials provided to you by Hersh, including details of the referee program and its terms and conditions, may contain confidential and proprietary information of Hersh. You agree that you will not, without the express written consent of Hersh, use, disclose or reproduce any such materials other than as required you’re your participation in Hersh’s referee Program.
You agree to indemnify, defend, and hold harmless Hersh and its affiliates from and against any and all losses, claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) to the extent they are caused by your actions or omissions and not by Hersh’s gross negligence or willful misconduct. Under no circumstances will Hersh be liable to you for (1) any incidental, indirect, consequential or punitive damages, or any loss of revenue or profit, that results from my participation in Hersh’s referee Program, or (2) any amount in excess of £2,500.
You agree that participation in the Referral Program is subject to acceptance by Hersh. Hersh may terminate your participation if, in Hersh’s sole discretion, you fail to comply with the requirements of Hersh’s Referral Program (including these Terms and Conditions).
Hersh may change, amend or discontinue its Referral Program at any time, without notice, at its sole discretion.
Hersh’s Referral Program (including these Terms and Conditions) shall be governed by and construed in accordance with the laws of the United Kingdom (without regard to its conflicts of laws principles).
Min spend for Hersh Event is £399 and for Hersh Hamper £100. One discount can be use per order. Account will be created in your name and can only be redeemed by you
Your reward is personal to you and cannot be transferred to anybody else. rewards may only be redeemed and earned in accordance with these terms and in the order that is stated, you cannot apply all the discount at once
Our Privacy Policy relating to this Loyalty Programme which can be accessed on our website privacy policy sets out the information that we will collect about you, how we use the information and whom it may be shared with including, but not limited to, details of the promotional information that we hope to provide.
We will retain your personal information for as long as you are a member of the Loyalty Programme. You may cancel your membership at any time by contacting us via email
HERSHEVENTS
BOOKING FORM INFORMATION
If you book our services you are agreeing to comply with and be bound by the following terms and conditions of hire.
GENERAL
The ‘Company’ is Hersh Event LTD. The ‘Hirer’ is any person or company who hires or has agreed to hire Goods from the Company. ‘Goods or equipment’ means goods provided by the Company in accordance with the Company’s standard Terms and Conditions of hire.
ACCEPTANCE OF CONDITIONS
The customer’s acceptance of goods on hire implies acceptance by signing and agreeing to our Conditions of Hire as given below.
RETENTION OF TITLE
All goods remain the absolute property of the company and the customer undertakes not to sell, offer to sell, assign charge, pledge or underlet, lend or otherwise deal with the products unless agreed otherwise with the company.
BOOKING
A 30% non-refundable deposit is required to reserve your booking with us. Bookings can be completed on our website. And the remaining balance is required one week before the event date. And updated invoice will be sent
MINIMUM SPEND
A minimum spend requirement of £150. Delivery price depends on location
DAY OF SETUP
On the day of setup, we will require the function room to be clean and tidy, you will need to arrange with the venue setup of the table items after the ceremony. We are unable to wait or move items unless pre-arranged with us. It is your responsibility to check that all Items have been provided and to notify us immediately if any discrepancies. Any additional decor added to any of our hired products must be removed prior to our collection or costs maybe incurred for the additional time taken to remove such items. We are unable to un-stack or arrange items at your venue without your consent. This is something you will need to arrange prior to our arrival. If there is an issue and you do require us to move big items additional charge for this Service. We will only provide the items as discussed and confirmed on your booking.
HIRE OF GOODS
As much as we try to eliminate marks and small stains form all our products, due to the items not being new, there maybe times where there may be marks.Being a hire product along with all our other hired items, there may have slight scratches and marks, none of these items are new so will have a slight wear and tear.
COVER LOSS OR DAMAGE OF HIRED EQUIPMENT
The Customer assumes complete responsibility for loss of, or damage to the hire products (other than fair wear and tear) from the time the equipment is delivered to the venue/premises, and until it is collected. The charge will be for the cost of replacing the equipment with new stock. For a full list of the prices please contact us. We strongly recommend you taking out insurance for such instance.
PAYMENT FOR DAMAGED OR MISSING ITEMS
By accepting the booking form you are happy for us to take payment. If we do need to use the Pre Authorised card then we will send you a receipt along with a description of the goods that were missing/damaged. We strongly recommend that you sign the hired items in and out before they are collected by our stylists. If you are unable to do this we will check the items at both the venue and our warehouse and our decision is final.
BADLY STAINED
Where our hired items are returned badly stained or soiled, or may require additional work to get the product back to a re-hireable standard, there may be an additional cleaning time added to your account. Examples of this are; Candelabras/Mirrors with excessive candle wax.
HIRE CHARGES – PERIOD OF HIRE
The hire charge for the products commences from the time that we dress the venue, and continues until the equipment is collected.
PAYMENT CANCELLATION
The full balance is due 1 weeks prior to your event date and an invoice will be sent 2 weeks in advance. Once the invoice has been paid we cannot issue refunds but can exchange items or offer a credit note. Cancellation within 72 hours will result in the forfeit of full payment we reserve the right invoice in full for loss of work.
Cancellation must be made in writing by email to hershevents@hotmail.com.We will write to you confirming the cancellation so please do contact us if you haven’t heard from us as we may not have received your request.
CHANGES TO AN ORDER
You are able make changes to your order up until; either where full payment has been made. Once full payment has been made these items are assigned to you and your event. Significant changes to an order may change the quote you originally obtained. Items can be added on as long as they are in stock at any point.
DISCREPANCIES
Any discrepancies with an order must be notified within 7 days after the event in writing. Any discrepancies that are not notified during this period will be exempt from any credit/refund. We recommend you contact us immediately if there are any questions or issues relating to your booking so we have the opportunity to resolve it as soon as possible.
ADVERSE WEATHER CONDITIONS
We cannot accept responsibility for any of our items that are used outside should they be damaged, soiled or affected by weather conditions after we have left them – Examples are; Aisle Runners getting wet & badly soiled (There may be an additional cleaning fee should the item be badly soiled or charged at replacement cost in the event cleaning fails), Outside gazebos where fabrics are affected by wind or rain. Swagging & Draping are intended as temporary constructions, severe weather conditions may affect the completed look. In the event of adverse conditions, it is Hershevents sole discretion on all outside decor if to provide the hired items due to potential damage and safety. Therefore, additional charges are given for any items not used under such incidences or should be affected by weather.
CANCELLATION DUE TO ADVERSE WEATHER OR LOCKDOWN
In adverse weather conditions such as Snow & Ice, it is Hershevents decision not to deliver/setup hired goods to the venue if it jeopardises the safety of our staff. Hershevents will endeavour to get the hired goods to the venue and exhaust every option that is available before cancellation of the booking. It is the responsibility of the hirer to make sure the hired goods are insured for such incidences.
Timeslots
Should we be required to dress an event or collect customers will be given the timeline on when we may be arriving. Depending on the packages selected customers can pay extra to select what time slot they would like otherwise an allocated time slots will be provided.
TERMINATION OF LIABILITY
The Company shall be relived of all liability for obligations incurred to the Hirer and any other third party.
LAW
This contract shall be governed by English Law in the Courts of England.
HERSHHAMPERS - TERMS & CONDITIONS
Any use of the HershHampers website is subject to the user agreeing to the following Terms and Conditions.
These conditions shall apply to all online transactions between HershHampers ("HershHampers ") and any person, firm or company ("the Purchaser") placing an order online with HershHampers for the supply of any goods ("the Goods"). Web prices exclude delivery costs. In the event that an incorrect price is displayed on our website, HershHampers reserves the right to abstain from fulfilling the order at that price. The customer will be notified by email and given the choice to proceed with the order.
All transactions are processed by PayPal and credit/debit card payments can be made using Visa, Paypal and Mastercard. HershHampers provides a 100% secure payment system. All transactions are processed by Paypal.
3. RETURNS, CANCELLATIONS & DAMAGES
We want you to be completely satisfied with your purchases and the service we provide and we offer a full "no questions" refund if you are not satisfied 100%. In accordance with the UK Online Selling Directive you have the right to cancel the contract at any time up to 7 working days starting the day after delivery.
Please note that the customer must bear the cost of returning the goods to us. And the good must not be retuen UNOPENED.
i) RETURN (if an order has already been delivered)
TO RETURN AN ITEM:

On receipt of the goods, we will refund the value of the order in full. You will receive an email confirming your refund within five working days of us receiving the return.
ii) CANCELLATION (if an order has yet to dispatch)
You can cancel an order up to 24 hours after the order has been placed before delivery date. After this we may have already dispatched your gift.
If we receive notice of your cancellation later than the above, it may be too late to halt the delivery. To cancel your order if the goods have already been dispatched, please notify our customer services team by email: Hershevents@hotmail.com, and we will instruct you on the next steps.
iii) DAMAGES
In the unlikely event of damaged goods the Purchaser should contact HershHampers within 3 days of receipt of the Goods. HershHampers will replace or refund the items concerned.

ii) SUBSTITUTIONS
7. While we always endeavour to keep photography and descriptions as accurate as possible, HershHampers reserves the right to substitute any items included in hampers for items of equal or greater value if those listed in the descriptions are out of stock or unavailable at the time of ordering. Hamper contents can vary slightly from the image displayed so please see the product descriptions for full listings. Glasses, utensils, decorations and other props shown in photographs are not included in the gift unless specifically listed.
5. ALCOHOL
No persons under 18 years of age may place an order or receive Goods from HershHampers if the Goods contain alcohol. All hampers including alcohol require photo ID to be emailed prior to the hamper being sent out .
6. FORCE MAJEURE
HershHampers will exercise every reasonable effort to meet the requested delivery date. HershHampers shall not, however, be liable for any loss or damage due to delays or failure to ship resulting from any cause beyond its reasonable control, such as, but not limited to, compliance with laws or regulations, acts of God, acts or omissions of the Purchaser, acts of civil or military authority, judicial action, defaults of sub-contractors or suppliers, labour disputes, failure or delays in transportation, embargoes, wars or riots.

HershLoyalty Card PROGRAMME
You are automatically part of the Loyalty Programme after your 1st booking or order is placed and an email of your HershHershLoyalty Card will be sent to you via email. you accept these terms and conditions. We may refuse an application to join the Loyalty Programme for any reason at our sole discretion including (but not limited to) risk of reputational damage to us, any reasonable suspicion of previous criminal activity including shoplifting or any previous history of verbal or physical abuse to Hershstaff.
A Loyalty Account will be created in your name and can only be redeemed by you. You must be 16 years of age or over and resident in the UK to join the Loyalty Programme.
Your digtial HershHershLoyalty Card is issued to you but remains the property of Hersh.
Your HershLoyalty Card can be used online at www.Hersh.co.uk or by emailing us.
Your HershLoyality Card is personal to you and cannot be transferred to anybody else. Loyaltycard may only be redeemed and earned in accordance with these terms and in the order that is stated, you cannot apply all the discount at once
The HershLoyalty Card cannot be used for any transaction where the beneficiary is a business entity or for any other commercial purposes and is only for consumer use.
If you materially breach these terms, and where such breach can be remedied, if you do not remedy the breach within 30 days of a written notice of the breach from Hershor if Hersh reasonably believes that you have breached these terms and/or abused the Loyalty Programme, your HershLoyalty Card may be terminated, any points earned but not redeemed may be cancelled and your Loyalty account closed without prior notice. Hershreserves the right to take any action deemed necessary where a HershLoyalty Cardholder is found to have abused the Loyalty Programme.
In addition to the above, Hershreserves the right to (i) stop issuing HershLoyalty Cards at anytime if we decide to terminate the Loyalty Programme; (ii) to alter or amend the terms and conditions of operation of the HershLoyalty Card and/or the Loyalty Programme and/or (iii) withdraw or cancel the HershLoyalty Card (including but not limited to the redemption and issue of such) and/or Loyalty Account on reasonable notice to you by letter, email or publishing such notice on our website.
Our Privacy Policy relating to this Loyalty Programme which can be accessed on our website privacy policy sets out the information that we will collect about you, how we use the information and whom it may be shared with including, but not limited to, details of the promotional information that we hope to provide.
We will retain your personal information for as long as you are a member of the Loyalty Programme. You may cancel your membership at any time by contacting us via email
